Finding an employment lawyer to help isn’t always easy. We would suggest that you call a few offices to see who charges for consultations and who offers free consultations. You can also ask friends and contacts for referrals. It’s also very important that you hire a lawyer who specializes in employment law, that you hire local, and more importantly, that you hire a lawyer that you have a connection with – personality is a key fit.

You don’t need to hire an employment lawyer but remember, employment laws are constantly being updated, amended or completely revamped. If you been fired, we think it’s crucial that you have your severance package reviewed by an employment lawyer prior to signing off on any termination release. Once you sign, it’s almost impossible to go back.

Only a specialized employment lawyer would be able to tell you if you are severance is fair or not. If you been fired, it’s important that you call an employment lawyer sooner rather than later to determine whether or not you have been paid enough severance.

Unless your have suffered devastating injuries, such as paaraplegia or quaderiplegia, odds are that it is too soon to tell. If any personal injury lawyer provides you a promise to recover a certain amount of money, we would recommend getting a second opinion. We need to know the absolute extent of your maximum medical recovery since the extent of injuries tend to change over time.

Surprisingly, many claimants don’t realize that they are entitled to legal representation if the insurance company cuts off their disability benefits. Being cut off or denied your disability benefits is not the end of the road. You can hire a disability lawyer to challenge the insurance company’s denial.

It depends on the particular facts of your case – and whether your case is litigated or not. Some cases are so straightforward that we are able to work out a resolution with your disability claims adjudicator. Other times, lawsuits have to be issued. Cases could still resolve prior to or after depositions. All in all, disability cases take no less than 6 to 8 months, and no more than two years

The basis of your lawsuit to be seeking a declaration from a judge that you are disabled as per policy definition and you are entitled to long-term disability benefits from the time that you are cut off, into the indefinite future.

Yes. You would be awarded your past benefits from the date that you are cut off, to the date of the entered judgment. From there on your monthly disability payments would be reinstated.

Some cases can be settled. Because we are technically seeking a declaration from a court that you are disabled as per policy definition, you are not entitled to a lump sum settlement. However, we often enter into negotiations with disability insurance carriers to lump out a settlement that is reasonable to both parties

Most long-term disability policies in Ontario replace between 60% and 66.6% of your income.

If you are a member of a group policy, you would talk to your benefits administrator at your place of employment. If you purchased an individual policy, then you would speak to your disability insurance broker.
